OUR CONTRACT
Terms and Conditions:

Payments: All payments are due in full at the time of job completion. Our company requires an advance payment of 30% of the total bid price prior to the commencement of work IF your total bid price is above the price of two-thousand dollars. If the customer desires other payment arrangements, this must be approved by the said owner of Potter’s Tree Service.

Late Fees: If the customer fails to pay as previously stated a discretionary late fee of $30.00 may be applied per every seven days. Any late payment exceeding 60 days will be subject to an additional 5% late fee for each month passed before payment is received. A $50.00 discretionary fee shall be assed for all returned checks.

Completion of Contract: Potter’s Tree Service agrees to do its best to meet any agreed upon performance dates, but shall not be liable for delays due to inclement weather, labor, or any other cause beyond our control; nor shall the authorizing party be relieved of completion for delays. Potter’s Tree Service will work with all customers to complete all work within a reasonable time of 30 days, should any delay occur.

Tree Removal: The term “Removal” refers to the removal of a tree or shrub as close to the ground level as possible.

Stump Grinding: The term “Stump Grinding” refers to grinding surface material six inches below ground level as well as roots that do not exceed three feet from the stump site. The original bid agreement will include the individual price for each stump to be ground down. All stump grindings will be completed by a sub-contractor of this company. Potter’s Tree Service will be responsible for scheduling said work as quickly as possible; after tree removal completion. Potter’s Tree Service shall not be held liable for any damaged taken place during the stump grinding.

Clean-Up and Lawn Repair: It is our goal to pick-up everything we put on the ground. Clean-up shall include removing wood, brush, and raking the affected area specified to the work; unless otherwise noted on the proposal. Potter’s Tree Service will attempt to minimize all disturbances to the authorizing party’s lawn. Lawn repairs are not included in the contract price, unless noted otherwise on the proposal. Potter’s Tree Service shall not be held liable for repair on damages to lawns and/or gardens pertaining to marks or divots in lawns after completion of job, as this is reasonable damage that cannot be avoided. Potter’s Tree Service reserves the right to add a clean-up fee for job-site conditions should this be discussed between a designated representative of Potter’s Tree Service and the client/customer before commencement of job.

Driveways and Sidewalks: Potter’s Tree Service will attempt to minimize damage to driveways and/or sidewalks. In the event that our equipment causes settling, cracking, or any other damages to driveways and/or sidewalks are not included in the contract price. Potter’s Tree Service shall not be held responsible for reasonable damages for driveways, sidewalks, or any other hardscapes.

Concealed Contingencies: Any additional work or equipment repair required to complete the project, caused by the authorizing party’s failure to make known or caused by the previously unknown foreign material(s) in the trunk, branches, underground, stump, or any other condition not apparent in estimating the work specified, shall be paid for by the authorizing party on a time and material basis. Potter’s Tree Service is not responsible for damages to underground sprinklers, drain lines, invisible fences, underground cables, or any other unknown/hidden system(s) unless the authorizing party and a copy is presented before the project is performed. Potter’s Tree Service shall asses surrounding structures in relation to the tree(s) or shrub(s) that may be removed and/or trimmed. Potter’s Tree Service shall not be held liable for existing damages to a home, concrete, asphalt driveways, fencing, yards, or gardens.

Tree Ownership: The authorizing party warrants that all trees listed in the invoice are located on the authorizing party’s property, and, if not, that the authorizing party has received full permission from the owner to allow Potter’s Tree Service to perform the specified work. Should any tree be mistakenly identified as to ownership, the authorizing party agrees to indemnify Potter’s Tree Service for any damages and/or costs incurred from the result thereof.

Permits: The customer/client is responsible for all necessary permits unless Potter’s Tree Service has been contracted to do so for an additional fee.
By signing this agreement you:

Acknowledge that you have read and agree to all terms and conditions listed in this contract.

Give your consent for Potter’s Tree Service to begin work on the agreed upon commencement date.

Approve the entire job description as listed on the front page.

Ensure that you understand that you are responsible for paying Potter’s Tree Service in full at the time of your job completion.
